NEW YORK — Charges have been upgraded against the 38-year-old man accused of setting a fire in Queens that claimed the lives of four people, including a 3-year-old child, following a grand jury indictment handed down on December 15, 2026. The tragic incident, which occurred just off Cross Bay Boulevard in the Ozone Park area, sent shockwaves through the local community.

District Attorney Melinda Katz announced the new charges, reflecting the severity and fatal outcome of the blaze that devastated a two-family home on 97th Street.

Arson Suspect Faces Harsher Penalties

The accused, Miguel Ramirez, initially faced charges of arson and reckless endangerment after the devastating fire on November 28, 2026. Following an extensive investigation by FDNY fire marshals and NYPD detectives, the grand jury returned an indictment with multiple counts of murder in the second degree, manslaughter, and arson. Ramirez now faces significantly longer prison sentences if convicted.

"The egregious actions that led to this horrific loss of life demand the fullest extent of justice," District Attorney Katz stated in a press release. "We will vigorously prosecute this case to ensure accountability for the victims and their grieving families."

Community Grieves Loss of Lives

The fire, which erupted in the early morning hours, claimed the lives of 62-year-old Maria Gonzalez, her 40-year-old son Luis, 35-year-old daughter Sofia, and Sofia's 3-year-old child, Isabella. All victims were pronounced dead at the scene after firefighters recovered their bodies from the heavily damaged residence. The entire community, from the shops on Cross Bay Boulevard to the homes on the side streets, mourned the profound loss.

Local residents expressed sorrow and anger during a vigil held last week near the affected home. "It's unimaginable heartbreak for one family and for all of us here in Ozone Park," said Reverend Arthur Jenkins of St. Mary's Church on 101st Avenue. "A child's life was stolen, and that is something no community should ever have to bear."

Investigation Reveals Motive and Evidence

Investigators believe Ramirez, who had a prior relationship with one of the victims, intentionally set the fire following a dispute. Evidence presented to the grand jury reportedly included surveillance footage from nearby businesses along Cross Bay Boulevard, witness testimony, and forensic analysis from the fire scene.

FDNY Chief Fire Marshal Daniel Hegarty confirmed that accelerants were detected at multiple points within the structure. "Our teams worked tirelessly to ascertain the origin and cause of this fire, and the evidence points clearly to arson," Hegarty reported on December 10, 2026.

Support for Affected Families and Future Safety

The tragedy has prompted discussions among local leaders about fire safety awareness and assistance for families affected by house fires. Councilwoman Joann Ariola announced plans to host a fire safety workshop in early 2027 at the Ozone Park library, focusing on smoke detector maintenance and evacuation plans.

The community has rallied around the extended family of the victims, establishing a GoFundMe campaign that has raised over $50,000 for funeral expenses and support. Local news channels like ABC7 New York provided ongoing coverage of the incident.

Ozone Park Fire Safety Questions

Residents often ask how they can protect their homes from arson. Experts recommend installing working smoke detectors on every floor, maintaining clear exit paths, and being aware of suspicious activity in the neighborhood. Others inquire about the process of upgrading charges in criminal cases. Charges can be upgraded if new evidence emerges or if a grand jury determines that the initial charges do not fully reflect the severity of the crime, as happened in this Queens fire case. There are also questions about resources for displaced families. The American Red Cross, along with local community organizations, provides immediate shelter, food, and emotional support to families displaced by fires.
